Legal Information

This contract is an agreement between you (referred to as “the Customer”) and DESTINATION GREATNESS (referred to as “Destination Greatness”, “we”, “us”, “our”). It outlines how we will work together. These terms are extremely important, and you must agree to them before purchasing our service or participating in our events. By making a reservation or booking our service and participating in our events, you are agreeing to these terms and the terms specified in our Customer Participation Agreement, which can be found at http://www.destinatongreat.net/legal-stuff/customer-agreement.

Please note that we update these terms periodically, and we will notify you of any changes via email.

CUSTOMER PARTICIPATION AGREEMENT

For our policy regarding your purchase of our service and participation in our events, please review our Customer Participation Agreement, which is incorporated by reference into these Terms of Service. By accepting these Terms of Service, you are also accepting and agreeing to be bound by our Customer Participation Agreement, available at http://www.destinatongreat.net/legalstuff/code-of-conduct.

YOUR DESTINATION GREATNESS ACCOUNT

When you create an account with us, you confirm that you are at least 18 years old and that the information you provide us is accurate, complete, and up to date.

You are responsible for maintaining the security of your account and password. This includes restricting access to your computer and/or account.

You are fully responsible for any activities that occur under your account, username, and password.

If you become aware of any security breach or unauthorized use of your account, you must notify us immediately.

You must not create an account that misleads others into believing that you are someone else or another company.

You guarantee that the information in your profile does not contain any illegal, unethical, defamatory, offensive, fraudulent, private, or copyrighted material.

Destination Greatness will not be held liable for any actions or omissions by you, including any damages incurred as a result.

RESERVATION POLICY

To confirm your reservation, a non-refundable deposit payment is required. The remaining balance must be paid 60 days before the start date of your reservation. Failure to pay the remaining balance will result in the cancellation of your reservation without a refund. Reservations made within 60 days of the start date require full payment.

REFUNDS, TRANSFERS, AND CANCELLATIONS BY YOU

If you decide to cancel your reservation within the first 48 hours, Destination Greatness will refund all payments made by you. However, outside of COVID-19 or similar pandemic situations, no refunds will be issued if you cancel your booking after 48 hours of making the first payment for the reservation. You may transfer your reservation to another customer.

If your trip is proceeding but you need to cancel due to COVID-19, we will waive our standard cancellation terms for the following reasons:

  1. Your country of residence restricts travel.
  2. The destination you are traveling to restricts travel.
  3. You contract COVID-19 and are unable to travel, as evidenced by a positive test result from a recognized government test unless covered by your travel insurance.

In these cases, we will provide you with a free transfer to a future departure on the same trip, or offer a free transfer to another destination for the same price, or provide a full refund if applicable and possible.

In certain COVID-19 circumstances, our standard cancellation terms will apply. These include:

  1. Being denied boarding on your flight to the trip due to failing airline COVID-19 checks.
  2. Needing to self-isolate and therefore unable to continue your trip.

    In these cases, our standard cancellation terms will apply, and no refund or transfer will be provided.

    RESPONSIBILITY

    While Destination Greatness will make every effort to ensure the safety and well-being of its customers, participation in our events involves inherent risks. By agreeing to these terms, you acknowledge and accept these risks. Destination Greatness and its staff, agents, and affiliates will not be held liable for any injury, illness, damage, loss, or inconvenience sustained during your participation in our events.

    You are responsible for obtaining the necessary travel documents, including passports, visas, and any required vaccinations, for your trip. Failure to do so may result in the cancellation of your reservation without a refund.

    Destination Greatness reserves the right to make changes to itineraries, accommodations, and activities if necessary. We will inform you of any significant changes as soon as possible and provide suitable alternatives.

    Destination Greatness reserves the right to refuse or cancel a reservation at any time for any reason, including but not limited to non-compliance with our policies and code of conduct. In such cases, a refund will be issued for any payments made, excluding the non-refundable deposit.

    INTELLECTUAL PROPERTY

    All intellectual property rights, including trademarks, logos, images, and content, related to Destination Greatness are owned by Destination Greatness. You are not permitted to use, reproduce, or modify any intellectual property without our explicit permission.

    DATA PROTECTION

    Destination Greatness will collect and process personal information in accordance with applicable data protection laws and our Privacy Policy. By using our service, you consent to the collection and processing of your personal information as described in our Privacy Policy.

    GOVERNING LAW AND JURISDICTION

    These terms and any disputes arising from them will be governed by and interpreted in accordance with the laws of the jurisdiction where Destination Greatness is registered. Any legal action related to these terms shall be brought exclusively in the courts of that jurisdiction.

    These are the general terms and conditions for participating in our events and using our services. It is essential to review the complete terms and conditions, including the Customer Participation Agreement and Privacy Policy, on our website before making any reservations or bookings.

Destination Greatness Customer Participation Agreement and Assumption of Risk by Customers

This agreement, between you (referred to as “the Customer”) and Destination Greatness Travel Company (referred to as “Destination Greatness,” “we,” “us,” or “our”), outlines the risks associated with our services (referred to as “event,” “activity,” “tour,” “package,” or “service”) and your acceptance of those risks. Please read and understand these terms before participating in our events. By purchasing our service and participating in our events, you are agreeing to these terms.

We may update these terms periodically, and we will notify you of any changes through an in-app notification in your portal or via email.

Agreement: You acknowledge that attending and participating in our events, including indoor and outdoor activities, involve risks, and you are aware of the inherent dangers associated with these activities. By agreeing to this release, you absolve and hold harmless Destination Greatness, its owners, agents, employees, and contractors from any liability for injury, illness, disease, death, misadventure, harm, loss, inconvenience, or damage resulting from your participation in the contracted activity or any associated activities. This includes any harm, illness, death, disease, injury, or damages caused by the negligence or fault of Destination Greatness and its owners, agents, employees, and contractors.

If an organization or corporation sponsors an individual, the organization or corporation is responsible for providing a copy of this agreement to the sponsored individual. The organization or corporation also agrees to indemnify, defend, and hold harmless Destination Greatness against any claims made by the sponsored individuals.

You understand that this release is an ongoing agreement between Destination Greatness and yourself, your family members (including minor children), and employees or contractors sponsored by your organization to attend the event. In consideration of Destination Greatness accepting your purchase and participation, you release and discharge Destination Greatness and its owners, agents, employees, and contractors from any actions, claims, causes of action, expenses, damages, and demands, including claims for bodily injury, illness, disease, death, or loss of personal property, arising from your participation or your organization’s participants’ participation in the contracted activities, scheduled or unscheduled. This release covers claims or demands based on the negligence or fault of Destination Greatness and its owners, agents, employees, and contractors.

You understand and agree that Destination Greatness may arrange for other entities to provide indoor and outdoor activities for event participants. You release and discharge Destination Greatness and its agents, servants, employees, and officers from any claims relating to the selection or suitability of these entities to provide the activities. You also acknowledge that safety laws, regulations, and requirements for indoor and outdoor activities may differ from your home country’s laws. You release and discharge Destination Greatness and its agents, servants, employees, and officers from any claims related to medical services or care in the host country.

By participating in the activities, you expressly and voluntarily assume the risks and dangers of personal injury, death, or property damage resulting from or related to your participation or the participation of your organization’s participants in the contracted activities, including scheduled or unscheduled events.

You represent that you, your family (including minor children), and your organization’s participants are in good health without physical or mental defects that may pose a danger during the activities. You agree not to consume alcoholic beverages or substances that impair your senses before or during the activities.

You understand that the risks and dangers of participation may arise from various causes, including negligence of Destination Greatness, negligence of other participants, negligence of others, accidents, breaches of contract, forces of nature, and other causes.

In consideration of Destination Greatness accepting your purchase and participation, you release Destination Greatness’s participating partners, servants,

agents, employees, successors, and/or assigns from any claims for loss or injury of any kind arising out of your participation in the activities of the event.

This Express Assumption of Risk and Release of Liability also serves as a waiver for any protection that may be provided by any statute or law in any jurisdiction. Such laws intend to limit the scope of a general release to claims that the person giving the release does not know or suspect to exist at the time of executing this Release of Liability.

Furthermore, having read and understood this agreement, by accepting it on behalf of yourself, your family (including minor children), and your organization’s participants, you forfeit valuable rights and agree not to sue Destination Greatness, its owners, employees, agents, and contractors in your individual or organizational capacity, or in your capacity as a parent/guardian or next friend. You freely and voluntarily agree to the terms of this agreement.

You also agree to comply with all information, instructions, and rules provided by Destination Greatness, including those communicated through literature, owners, employees, agents, or contractors, both during the check-in process and while participating in any activities.

Furthermore, you grant permission to Destination Greatness to use any written comments, pictures, videos, and/or movies in which you may appear for publicity, promotion, and advertising purposes related to Destination Greatness and its services.

Any dispute arising out of this agreement or otherwise between the parties, in which Destination Greatness or its agents are a party, shall be subject to the jurisdiction of the courts in Brooklyn, New York, U.S.A.

By purchasing Destination Greatness services and participating in the event, you agree to the terms of this agreement and release of liability. If you do not agree with this release of liability, your only option is to discontinue the use of Destination Greatness services and refrain from participating in the event. You acknowledge that you may receive additional safety information or on-site guidance that will enhance your understanding of the risks associated with Destination Greatness activities. You have the right to choose not to participate in any specific activity during the event, either before or after it has begun, and Destination Greatness reserves the right to modify or refuse participation to individuals with medical or physical conditions that may expose them to inappropriate levels of risk.

The Destination Greatness Code of Conduct (referred to as “The Code”) emphasizes the importance of honesty, integrity, and ethical behavior for everyone associated with Destination Greatness. It promotes respect and tolerance towards one another. In order to participate in our travel experiences, it is mandatory for you to agree to The Code. Please note that The Code itself is not a contract and does not create any contractual rights between Destination Greatness and participants or staff.

We periodically update The Code and will notify you of any changes via email.

INFORMATION

Destination Greatness is committed to ensuring respect and tolerance for diverse groups of individuals. To maintain a safe and productive environment, all participants (referred to as “Travelers”), staff, and staff of partner organizations are expected to adhere to this Code of Conduct. When The Code mentions “Travelers,” it includes all individuals using Destination Greatness’ services. We expect Travelers and staff to act with respect and tolerance when interacting with each other and the world. By traveling with us or working with us, you represent yourself, your home country, and the Destination Greatness community. Please abide by this Code of Conduct and represent Destination Greatness in a manner that reflects positively on the entire community.

This means that your actions must be free from discrimination, libel, slander, or harassment. You are responsible for your own actions, and misconduct cannot be excused by claiming it was directed or requested by someone else. If you become aware of any illegal or unethical acts, it is your responsibility to inform Destination Greatness. No one will face retaliation for reporting a suspected violation in good faith.

Travelers who violate The Code will be subject to disciplinary action, which may include removal from the Destination Greatness travel experience. (Note: Any guests or visitors brought by Travelers to Destination Greatness accommodations, workspaces, or events are also expected to adhere to The Code and may be banned if they fail to do so.) Staff members who violate The Code may face disciplinary action, including dismissal. You may be required to periodically review The Code and acknowledge your understanding and compliance.

PERSONS LIVING WITH DISABILITIES

Destination Greatness acknowledges that some individuals may have physical and/or mental disabilities. We will strive to provide reasonable accommodations unless doing so poses a direct threat to these individuals or others, violates local laws, or creates an undue hardship for Destination Greatness. For more information or to discuss accommodation requests, please contact your Experience Ambassador (for Travelers) or your People representative (for staff).

ANTI-HARASSMENT AND ANTI-DISCRIMINATION Destination Greatness is dedicated to providing a harassment-free environment and strictly prohibits any form of harassment or discrimination, especially based on race, color, ethnicity, religion, gender, age, sex, sexual orientation, national origin, disability, veteran status, marital status, gender identity and expression, physical appearance, body size, and technology choices. Prohibited harassment includes inappropriate use of sexual images, deliberate intimidation, stalking, harassment through photography or recording, disruption of events, inappropriate physical contact, and unwelcome sexual attention. Engaging in such activities may result in disciplinary action, including removal from the Destination Greatness experience (for Travelers) or dismissal (for staff).

SEXUAL HARASSMENT

Sexual harassment is a form of sex discrimination that is prohibited by law and violates The Code. Prohibited conduct can be verbal, visual, or physical in nature. It includes unwelcome sexual advances, requests for sexual favors, and other forms of sexual conduct or the exchange of favors in response to sexual conduct. Even subtle behaviors, such as using foul or obscene language, posting or viewing inappropriate content on social media, gossiping, asking intrusive questions about someone’s sex life, displaying offensive

images or materials, making derogatory comments or jokes of a sexual nature, or engaging in unwelcome physical contact, may constitute sexual harassment.

Destination Greatness is committed to maintaining a safe and inclusive environment free from sexual harassment. If you experience or witness any form of sexual harassment during your travel experience, please report it immediately to the Destination Greatness staff or your assigned Experience Ambassador. Reports of sexual harassment will be taken seriously and will be handled promptly and confidentially.

RETALIATION

Destination Greatness strictly prohibits retaliation against any individual who reports a suspected violation of The Code in good faith or participates in an investigation. Retaliation includes any adverse action, such as intimidation, threats, harassment, or adverse treatment, taken against an individual as a result of their involvement in a complaint or investigation. If you believe you have been subjected to retaliation, please report it immediately.

RESPONSIBLE USE OF ALCOHOL AND DRUGS

Destination Greatness is committed to promoting responsible and safe behavior, including the responsible use of alcohol and drugs. All participants are expected to comply with local laws and regulations regarding the consumption and possession of alcohol and drugs. Illegal drug use and excessive or irresponsible consumption of alcohol are strictly prohibited during Destination Greatness experiences. Participants found to be in violation of these guidelines may be subject to disciplinary action, including removal from the travel experience.

ENVIRONMENTAL RESPONSIBILITY

Destination Greatness is dedicated to preserving and protecting the environment. We encourage all participants to be mindful of their impact on the environment during their travel experiences. This includes respecting local ecosystems, minimizing waste, conserving water and energy, and participating in sustainable practices whenever possible.

RESPECT FOR CULTURAL DIVERSITY

Destination Greatness celebrates and respects cultural diversity. Participants are expected to be respectful of the local customs, traditions, and beliefs of the communities they visit. Cultural sensitivity and open-mindedness are essential in fostering positive interactions and meaningful cultural exchanges.

COMPLIANCE WITH LOCAL LAWS AND REGULATIONS

Participants are required to comply with all applicable local laws and regulations during their travel experiences. It is the responsibility of each participant to familiarize themselves with the laws and regulations of the countries they visit and to conduct themselves accordingly. Violations of local laws and regulations may result in legal consequences and disciplinary action by Destination Greatness.

ACKNOWLEDGEMENT AND ACCEPTANCE

By continuing to use Destination Greatness services or participating in a travel experience, you acknowledge that you have read, understood, and agree to abide by The Code of Conduct. You understand that failure to comply with The Code may result in disciplinary action, including removal from the travel experience or termination of employment (for staff).

Destination Greatness reserves the right to modify The Code of Conduct at any time. It is your responsibility to review the most current version of The Code, which will be made available to you. Changes to The Code will be effective immediately upon posting or notification.

Destination Greatness Travel Company (“Destination Greatness,” “we,” “us,” “our”) is committed to protecting and respecting your privacy and complying with data protection laws. We may collect, process, use, and disclose your information when you use our website www.destinationgreatness.net, and/or the Destination Greatness App (together, the “Destination Greatness Platform”) and the services offered by Destination Greatness or third-party operators (the “Operators”) through the Destination Greatness Platform (the “Services”) as described in this Privacy Policy. “You” and “your” when used in this Privacy Policy include any person who accesses the Destination Greatness Platform or uses the Services.

COLLECTION OF INFORMATION

We may collect personal information about you that you provide to us while using the Destination Greatness Platform and information about how you use the Destination Greatness Platform, including when you open your user account (“User Account”), visit the Destination Greatness Platform, make reservations for any intended Services, or use the Services.

  1. Opening Your User Account: When you open a User Account with us or update any information in your User Account, we may collect your personal information, such as your name, email address, mobile number, country, gender, and password.

  2. Making Reservations for the Services or Using the Services: (a) When you visit the Destination Greatness Platform (even if you have not registered a User Account or logged in), make reservations for any intended Services, or use the Services, we may collect and process certain information (which may contain your personal information or non-personally identifiable information linked to your personal information) including, but not limited to, the following:

  • Copies of correspondence (whether by email, instant or personal messaging, or otherwise) between you and us, and between you and the Operators.
  • Details of your usage of the Destination Greatness Platform (including traffic data, location data, and length of user sessions).
  • Feedback and responses to surveys conducted by Destination Greatness relating to the Services and newsletters published, circulated, or distributed by Destination Greatness.
  • Information automatically collected and stored on our server or the server of our third-party services provider when you use or access the Destination Greatness Platform (including your User Account’s login name and password, your computer’s Internet Protocol (IP) address, browser type, browser information, device information, pages visited, previous or subsequent sites visited).
  1. When you use your mobile devices to visit the Destination Greatness Platform, we may collect information about you and your mobile device as stated above. This may include location information if you have consented and configured your mobile device to send us such information or upload photos with location information to the Destination Greatness Platform. We will use this location information as stated in this Privacy Policy, such as suggesting nearby Services during your travel or providing personalized content. You can change your mobile device’s privacy settings at any time to deactivate the function of sharing location information. Please note that some features of the Destination Greatness Platform may be affected if you turn off this location sharing function. If you have any questions about your mobile device’s privacy settings, we recommend contacting your mobile services provider or the manufacturer of your device.

  2. For your payment safety and to prevent misuse of your credit card information, Destination Greatness may ask for your credit card details and a copy of a government-issued ID to verify your purchase after payment is complete. For privacy reasons, you will be asked to cover your ID number and all but the last four digits of your credit card number.

STORAGE OF INFORMATION

The personal information and other data we collect from you may be transferred to, processed, and stored on our servers or the servers of our third-party service providers. Your personal information will be stored for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable laws and regulations. We will take reasonable steps to ensure that your personal information is treated securely and in accordance with this Privacy Policy.

USE OF INFORMATION

We may use the information we collect from you for the following purposes:

  1. To provide the Services: We use your personal information to facilitate and fulfill your reservations for the Services, communicate with you regarding your reservations, and provide customer support.

  1. Operators: We may share your information with the Operators to facilitate and fulfill your reservations for the Services.

  2. Service Providers: We may engage third-party service providers to assist us in providing and improving the Destination Greatness Platform.   3. Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., law enforcement or government agencies).

  4. Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity.

COOKIES AND SIMILAR TECHNOLOGIES

We use cookies, web beacons, and similar technologies to collect information about your usage of the Destination Greatness Platform. These technologies help us analyze trends, administer the platform, track users’ movements, and gather demographic information.
